We at MonKey FunKey Apps LLC (“FunKey,” “we,” “us,” or “our”) created this privacy policy (“Privacy Policy”) because we know that you care about how information you provide to us is used and shared. This Privacy Policy relates to the information collection and use practices of MonKey FunKey Apps LLC, a South Carolina limited liability company in connection with your access to or use of: our mobile application known as ChimpKey (“ChimpKey”), our website located at www.chimpkeyboard.com (the “Site”), and any services and tools provided on, by, or in relation to, ChimpKey or the Site. ChimpKey, the Site, the services and tools, are collectively referred to as the “Services” in this Privacy Policy.

We strive to educate parents and kids about how to appropriately safeguard their privacy when using our Services. We are committed to complying with the Children’s Online Privacy Protection Act of 1998 (“COPPA”), which requires us to inform parents and legal guardians about our information collection and use practices. COPPA also requires that we obtain parental consent before we knowingly allow children under the age of 13 to access and/or use our Services. We urge kids to check with their parents before entering information through our Services, and we recommend that parents discuss with their kids restrictions regarding the online release of personal information (e.g., first name, last name, birthday, email address, home address, etc.) to anyone they don’t know.

By accessing or using our Services, or by permitting your child to access or use our Services, you are agreeing to the terms of this Privacy Policy and the accompanying Terms of Use. Capitalized terms not defined in this Privacy Policy shall have the meaning set forth in our Terms of Use.

Information We Collect

Personal Information

We do not collect any personal information from you unless you voluntarily provide it to us.

When you (a “User”) initially download ChimpKey to your mobile device or when you visit the Site, you will be asked whether you wish to receive news and updates about the Services. If you elect to do so, you’ll be asked to provide your email address. Receipt of news has no effect on access to or use of the Services. In this Privacy Policy, we refer to your email address as “Personal Information.” Other your email address, we do not collect any Personal Information from Users.

MonKey does not collect or solicit any information, including any personally identifiable information, from anyone actually known to be under the age of 13 without the involvement of a parent or guardian. Although we do not affirmatively encourage or invite use of the Services by children under the age of 13, we recognize that some may attempt to use our Services. Since we do not require users to register in order to use ChimpKey*, there is no Personal Information collected by us from the use of ChimpKey+. In the event that we learn that we have collected Personal Information from a child under age 13 without parental consent, we will notify the child’s parent or guardian using the e-mail address (if one has been provided by the User+), alerting the parent or guardian to the child’s use of the Services, and we will delete the Personal Information as quickly as possible. MonKey does not knowingly use personally identifying information collected from children for marketing or promotional purposes, and does not knowingly disclose such information to any third party for any purpose whatsoever.

* – In-app purchases do require provision of credit card and related information, and is used only for the purpose of payment for such purchases. See Disclosure of Personal and Payment Information to Third Parties, below.

+ – As explained above, we do offer to send users who provide an email address to us information from time to time about new features of, and other news about, ChimpKey.

Usage Information

Usage Metrics: We do not directly gather information about you (e.g., the areas you visit on our website, your IP address, where you go on the World Wide Web). However, we may use Google Analytics to monitor usage metrics (“Usage Information”). Google Analytics is a web analysis service provided by Google. Google utilizes the data collected to track and examine the use of www.chimpkeyboard.com, to prepare reports on its activities and share them with other Google services. We do not control tracking technologies or other practices used by Google Analytics to collect information about you when you use ChimpKey. Google may use the data collected to contextualize and personalize the ads of its own advertising network. Google uses cookies and usage data, and processes your personal data in the USA. Please refer to the Google privacy terms for current information about how you may refuse the use of these cookies by selecting the appropriate settings on your browser (please note that if you do this, you may not be able to use the full functionality of the Site), and how you can prevent Google’s collection and use of data (cookies and IP address) by downloading and installing the opt-out browser add-on.  Find Google’s full privacy policy here.

Payment Information: If you choose to make an in-app purchase of a feature of ChimpKey that requires a fee, you will be required to provide us with your payment information, including, without limitation, bank account numbers, credit card or debit card numbers, account details, ACH information, and similar data (collectively, “Payment Information”).

How We Use Your Information

We may use your Personal Information in a manner that is consistent with this Privacy Policy and the context of our relationship with you. We will use your Personal Information and Usage Information collected through the Site for the following purposes:

• To respond to your requests and to provide you with the Services;
• To respond to your inquiries and contact you about changes to the Site and/or the Services;
• To send you notices (for example, in the form of e-mails, mailings, and the like) regarding products or services you are receiving, and for billing and collection purposes;
• To send you information we think you may find useful or that you have requested from us;
• To enhance and improve the Site or the Service, such as through personalized features and content;
• To analyze the use of the Site and the Service and the people visiting to improve our content and Site and the Service;
• To investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of our policies, or as otherwise required by law;
• For any other purposes disclosed at the time the information is collected or to which you consent; and
• As otherwise specifically described in this Privacy Policy.

We will use your Payment Information to process your authorized payments for our Services.

Disclosure of Personal and Payment Information to Third Parties

We do not disclose your Personal Information to third parties for their direct marketing purposes.

We, like many businesses, sometimes hire other companies to perform certain business-related functions. Examples include mailing information, maintaining databases and hosting services. When we employ another company to perform a function of this nature, we provide them with the information that they need to perform their specific function, which may include Personal Information.

We use a third party service provider to receive your Payment Information and process your payment. The third party service provider stores your Payment Information; we do not receive or store this information. Storage by the third party service provider of your Payment Information is subject to the privacy policies and practices of the third party service provider and is not subject to the terms of this Privacy Policy. By providing your Payment Information, you acknowledge and agree to use of such information by the third party service provider for purposes of processing your payment to us.

If we or all or substantially all of our assets are acquired, we expect that the information that we have collected, including Personal Information, would be transferred along with our other business assets.

We may disclose your Personal Information and Usage Information to government authorities and to other third parties when compelled to do so by government authorities, at our sole discretion, or otherwise as required by law, including but not limited to in response to court orders and subpoenas. We may also disclose your Personal Information and Usage Information when we have reason to believe that someone is or may be causing injury to or interference with our rights or property, other users of this Site, or anyone else that could be harmed by such activities.

How We Protect Your Information

We take commercially reasonable steps to protect the Personal Information from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. Please understand, however, that no security system is impenetrable. We cannot guarantee the security of our databases, nor can we guarantee that the information you supply will not be intercepted while being transmitted to and from us over the Internet. In particular, e-mail sent to or from us may not be secure, and you should therefore take special care in deciding what information you send to us via e-mail.

Accessing and Modifying Account Information

We strive to help parents ensure that their kids have a safe experience using our Services. Parents or legal guardians can review any Personal Information collected about their child under 13 years of age, have this information deleted, request that there be no further collection or use of their child’s Personal Information, and/or allow for our collection and use of their child’s Personal Information. To request any of the foregoing actions, please email us at chimpkeyboard@gmail.com, with “CHILD INFORMATION” in the subject line. We take steps to verify the identity of anyone requesting information about a child and to ensure that the person is in fact the child’s parent or legal guardian.

Links

The Site may contain content, services, advertising and other materials that link to websites operated by third parties. We have no control over those other sites, and this Privacy Policy does not apply to them. Please refer to the privacy policies of those sites for more information on how the operators of those sites collect and use your Personal Information.

Shine the Light Law

Under California Civil Code Section 1798.83, California residents who have an established business relationship with us may choose to opt out of our sharing their contact information with third parties for direct marketing purposes. We do not share email addresses with third parties for direct marketing purposes in any circumstance, so no opt-out is offered in this Privacy Policy.

Do Not Track

We do not monitor, recognize, or honor any opt-out or do not track mechanisms, including general web browser “Do Not Track” settings and/or signals.

Important Notice to Users Outside the U.S.

The Site is operated in the United States and the Services are available to Users who reside in the United States or any of its territories or possessions. If you are located outside of the United States, please do not access or use the Services.

Changes to This Privacy Policy

This Privacy Policy is effective as of the date stated at the top of this Privacy Policy. We may change this Privacy Policy from time to time and all changes will go into effect immediately when we post the revised Privacy Policy on the Site. By accessing or using the Services after we make any such changes to this Privacy Policy, you are deemed to have accepted such changes. Please refer back to this Privacy Policy on a regular basis so you are aware of any changes, as they are binding on you.
